Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WineJoys website at winejoys.com, the WineJoys mobile applications (when launched), and any related services (collectively, the “Services”). The Services are operated by Webair AI LLC (“Webair AI,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be of legal drinking age in your jurisdiction (21+ in the United States) to use the Services. By using the Services, you represent that you meet that requirement and that you are not barred from using them under any applicable law.

2. Description of the Services

WineJoys provides a curated directory of American wineries, an AI-powered wine bottle scanner that identifies wines from photos of their labels, editorial content about wine, and (forthcoming) a native iOS application that combines these features. The Services are provided for personal, non-commercial use only.

3. Acceptable Use

You agree not to:

• Use the Services to violate any law, regulation, or third-party right.
• Upload images that are not of wine bottle labels, that contain personal data of other people, or that you do not have the right to upload.
• Reverse-engineer, scrape, or attempt to extract the underlying data, models, or source code of the Services.
• Interfere with the operation of the Services, including by transmitting malware, attempting denial-of-service attacks, or circumventing rate limits.
• Use the Services to make commercial recommendations to third parties without our written permission.
• Use automated tools (bots, scrapers, headless browsers) to access the Services without our written permission.

4. AI-Generated Information

The bottle scanner relies on third-party AI models to interpret wine label images. AI output may be inaccurate, incomplete, or out-of-date. Information returned by the Services — including producer identification, vintage, region, alcohol content, estimated value, and tasting notes — is provided for general informational and entertainment purposes only. Do not rely on the Services for purchasing decisions, wine valuation for insurance, sale, or auction, or any decision involving more than nominal financial consequences. Always confirm important information against authoritative sources.

5. User Content

When you upload an image to the bottle scanner, you grant Webair AI a worldwide, non-exclusive, royalty-free license to process the image solely to provide the Services to you. We do not claim ownership of your uploaded images. We do not retain uploaded images after the analysis request completes; see our Privacy Policy for details.

6. Intellectual Property

The Services, including the WineJoys name, logo, design, editorial content, curated winery descriptions, structured data, and software, are owned by Webair AI LLC and protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works of the Services without prior written permission, except that you may share public links and quote short excerpts with attribution.

Third-party trademarks (winery names, region names, wine publications) are the property of their respective owners and are referenced for identification only.

7. Privacy

Our processing of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services and Links

The Services may link to or rely on third-party platforms (including OpenAI for vision analysis, Vercel for hosting, and third-party winery websites). Webair AI is not responsible for third-party content, terms, or availability.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Webair AI disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted service. We do not warrant that wine identifications are accurate, that estimated values are correct, or that the directory is complete or up-to-date.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBAIR AI LLC AND ITS OFFICERS, DIRECTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of the Services, including loss of profits, loss of data, or wine purchasing decisions made in reliance on the Services. Our aggregate liability under these Terms will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow exclusion of certain warranties or limitations on certain damages, so these limitations may not apply to you to that extent.

11. Indemnity

You agree to indemnify and hold Webair AI LLC harmless from any claim, demand, loss, or damage (including attorney’s fees) arising out of your breach of these Terms or your misuse of the Services.

12. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or harms other users or the Services. You may stop using the Services at any time.

13. Changes to These Terms

We may update these Terms from time to time. We will indicate the updated date at the top of this page and, for material changes, provide additional notice via the website or app. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. The exclusive venue for any dispute will be the state and federal courts located in New York County, New York, and you consent to personal jurisdiction there.
